“Due to
ongoing legal issues we are unable to continue processing. You do not need to mail your claims, unless you want to, but they
will most likely be returned as the FA has resigned and is not accepting mail. Our plan is to make payment to ALL voucher
holders from April 1, 2004 through Oct 31, 2008 claim pools. We are working to gain the States' cooperation in this matter
to allow us to make payment to all these consumers with outstanding vouchers. The escrow does remain in tact. As per the 'shortfall'
conditions, all voucher holders will receive a pro-rata payment for their share of the escrow proceeds." However, this
would normally apply to valid claimants and in this situation, it will apply to all voucher holders, regardless of when their
voucher was issued. Some of you will get an early payment, some of you have been awaiting payments. Some of you would never
claim or otherwise fail to claim properly, so even you will be receiving funds. The program was designed with the escrow in
place to protect all voucher holders in the event of NRF or the FA were no longer functioning, so this fail safe is being
enacted so that all consumers will receive at least something. Christiana Bank has received a lot of calls and is hopeful
this will not continue. Please avoid calling them, we urge you to contact either the State of CO AG office or the State of
WI AG office as they both have a copy of a verification letter from Christiana stating that indeed the escrow is still held
at the Bank.
